Update: Stolen Valor is a Crime: Is Johnny Bea in Violation of Federal Law?

medals

Update:  11/13/2013
As of now, it’s unsure if he actually has broke the Stolen Valor law since the law also states to Violate he has to make or received some sort of benefit from their wearing of Military Medals or uniforms. Though in the Videos he has said he done so.  Need evidence of Johnny Bea actually doing so.   Wearing the medals while receiving some benefit.

For those who say that Stolen Valor was overturned and that it protected speech. They are right that it was overturned by the Supreme Court but then Congress passed a new version of the law that protects the valor of those who serve.

H.R.258 — 113th Congress (2013-2014)

Stolen Valor Act of 2013 – Amends the federal criminal code to rewrite provisions relating to fraudulent claims about military service to subject to a fine, imprisonment for not more than one year, or both an individual who, with intent to obtain money, property, or other tangible benefit, fraudulently holds himself or herself out to be a recipient of:

  • a Congressional Medal of Honor,
  • a distinguished-service cross,
  • a Navy cross,
  • an Air Force cross,
  • a silver star,
  • a Purple Heart,
  • a Combat Infantryman’s Badge,
  • a Combat Action Badge,
  • a Combat Medical Badge,
  • a Combat Action Ribbon,
  • a Combat Action Medal, or
  • any replacement or duplicate medal for such medal as authorized by law.

So under Federal Law Johnny Bea (Name on Facebook)
Is in Violation of Wearing US Military Medals which he never earned because of not serving in the US Military is in Violation of Federal Law.

JohnnyWearing MedalsAs you notice, he is wearing a Purple Heart which is mentioned in the Stolen Valor act as prohibited as well as Bronze Star being worn on a Purple Heart Hat.

Query, what law was in place when this idiot made the video? If he broke the law under the previous Stolen Valor act, then he cannot be prosecuted for it. However, if he made the video since the enactment of the revised Stolen Valor act, then he can be prosecuted under the current law. Do you know when this video was made?

The Video that everyone got up and arms against was from November 10th 2011, but the second video that has him wearing a purple heart hat with Medals on it was from November 6, 2013 (After the law has went into effect.)

Unlesa you caught him in the act of recieving any beneifits he has not broken any laws. Owning the medals isn’t agaist the law.

Yes, I know we need someone to catch him wearing it in public and benefiting from the wear of it. He has said in his own videos that he goes to restaurants and get his Blooming Onion from Outback. Was hoping we could get someone at those locations to photo him wearing uniform and obtaining the benefit as a veteran while wearing such medals.

Valor: strength of mind or spirit that enables a person to encounter danger with firmness : personal bravery. – So by Definition no scum bag freedom destroying U.S Troop has any type of Valor to steal anyways.

Listen the best way to catch him is at a WWE event. They are very few times a week at sanctioned locations. He said it himself, “I get front row seats and meet the super stars”. That right there would be proof enough since all of these events have cameras.
